Order Rescheduling Hearing

On December 23, 2022, the Tenant filed a motion requesting a continuance to file his brief by no later than January 10, 2023, due to personal illness and a death in the family. The Housing Providers take no position on the Tenant’s request.

The Commission’s applicable rules require good cause to grant any continuance. See 14 DCMR § 3815.2 (2004). Our recently revised rules, 14 DCMR § 3815.4 (2021), also require good cause and further state that first requests for continuances should be granted liberally. This is the Tenant’s first request for an extension of the briefing schedule.

Accordingly, the revised schedule for the remaining briefing and argument is as follows:

  • The Tenant may file a responsive brief (including argument on the Tenant’s issues raised on cross-appeal) no later than January 10, 2023;

  • The Housing Providers may file a reply to the Tenant’s brief no later than 10 days from the date the Tenant’s brief is due, that is, on or before January 20, 2023;

  • The Commission will hold its hearing on February 7, 2023 at 11 am EST.
